Rules and Regulations
In an effort to provide an inviting atmosphere for all Owners docking at Epic Marina, the following Rules and Regulations are provided for your protection and constitute part of and are incorporated into the License Agreement for Dockage Space. Your adherence to and compliance with the following Rules and Regulations is required and is appreciated.
1. When any boat enters the Marina, the Owner, crew, and guests must comply with all Rules and Regulations as set out herein or as amended by the Marina from time to time.
2. Only boats in good condition and under their own power shall be admitted to the berthing areas. In the event of an emergency during the Owner’s absence (including, but not limited to breakdown of the bilge pump, leaks, bad lines, etc.), the marina is authorized, but not required, to make necessary repairs, which shall be charged to the Owner. If the Marina takes such action, it will endeavor to do so as economically as possible.
3. Pets must be leashed within the confines of the Marina and may be toileted only on grass areas. Pets are permitted only to the extent that they do not disturb other guests.
4. The Rules of the Road and navigational laws of the United States apply to all vessels within the Marina.
5. Refuse shall not be thrown overboard. Garbage must be deposited only in cans (bins) or other receptacles provided for the purpose. Owners shall notify the Marina of anything that will not fit in said cans and the Marina shall dispose of same. No person shall discharge oil, fuel spirits, inflammable substances, or oily bilges into or near the Marina. Charcoal or gas fires are not permitted on the docks.
6. Noise shall be kept to a minimum at all times. Patrons shall exercise discretion in operating engines, generators, radios, and television sets, etc., so as to avoid creating a nuisance or disturbance. The use of mechanical tools (buffers, sanders, etc.) outside of the boat is prohibited. All boats must have underwater exhaust in operation.
7. Owners shall not store supplies, materials, accessories, or debris on walkways, docks, or finger piers and shall not construct or place thereon any lockers, chests, cabinets, or similar structures, except upon approval in writing from the Marina. Painting, scraping, or repairing gear is prohibited on the walkways, docks, and finger piers. The extent of repairs and maintenance permitted shall be at the sole discretion of the Marina.
8. No advertising or soliciting is permitted on any boat within the Marina. Neither the boat nor Epic Marina, its name, address, or phone number shall be used for business purposes by Owners. Commercial vessels in the commercial zone with written authority from the Marina are exempt from the provisions of this paragraph.
9. Swimming, diving, and fishing are prohibited in the Marina.
10. Laundry shall not be hung on boats, walkways, docks, or finger piers, nor shall “for sale” or “for hire” signs be placed on boats.
11. Owners checking out of the Marina shall report to the dockmaster’s office and settle their accounts prior to leaving. It is recommended that all Owners leave a forwarding address to permit prompt handling of any telephone calls or mail. However, in any event, the Marina assumes no responsibility whatsoever for forwarding mail or messages.
12. All personal property must be removed from the Marina when dockage is terminated. The Marina assumes no responsibility for any personal property remaining within the Marina after dockage is terminated.
13. The Marina reserves the right to limit and govern parking spaces in the Marina area.
14. Motorcycles, bicycles, skateboards, and roller blades shall not be ridden on any walkways, docks, or finger piers. The same must be stored on the boat or in the parking lot.
15. Dinghies must be berthed within the slip assigned to the boat and in such a manner as to not interfere with the adjoining slip.
16. All lines, rigging, and halyards shall be secured by the owner to eliminate noise; slotted masts shall have noise protection devices.
17. If a vessel contains a sanitation device aboard, the same must comply with the most advance state-of-the-art requirements of the Coast Guard governing installation and use of such device. The sanitation device must be properly functioning at all times while the vessel is at berth. No discharge or sanitation effluent or dumping of trash overboard shall be permitted within the Marina.
18. Any charter operation utilizing the Marina must have in full force and effect at all times minimum cover of $1,000,000 of liability insurance.
19. Vessels and outside workers must present certificates of liability insurance at limits to be set by the Marina.
20. Employees of the Marina shall not be hired to perform any work on any vessel at the Marina nor may they be hired to perform any personal task for or on behalf of any patron or guest at the Marina.
21. Unauthorized use of Marina-supplied fresh water is prohibited.
22. There shall be created NO WAKE within the Marina.
23. Violation of any of these Rules and Regulations, as amended from time-to-time, disorder, or indecorous conduct by Owner, his crew or guests, that might injure a person, cause damage to property or harm the reputation of the Marina shall be cause for immediate removal from the Marina of the boat in question.
OWNER ACKNOWLEDGES HAVING READ AND UNDERSTOOD ALL OF THE RULES AND REGULATIONS OF THIS AGREEMENT AND AGREES TO ABIDE THEREBY.
